The term “consumer bankruptcy” includes both Chapter 7 and Chapter 13 bankruptcies. It can also include any bankruptcy proceeding in which an attorney represents an individual debtor, rather than a business or an entity.
Once the decision is made by a consumer to declare bankruptcy, the Bankruptcy Code provides for two primary alternatives. First, Chapter 13 allows for the reorganization of the obligations through debt adjustment. For a Chapter 13 bankruptcy, the debtor is required to pay at least part of the debts that he or she owes. A Chapter 13 proceeding is initiated by a voluntary action by the debtor.
Second, Chapter 7 of the Bankruptcy Code allows for the liquidation of the debtor’s non-exempt assets and distribution of the proceeds to the creditors. An action under Chapter 7 may be initiated voluntarily by the debtor or involuntarily by the debtor’s creditors. The clerk of the bankruptcy court must provide notice to the debtor of his or her option to proceed under Chapter 7 or Chapter 13.
